1. Who we are
Whomie is a mobile app for people who are looking for a room or a flatmate. You can create a profile, browse people and room listings near a location, filter them, and chat.
Whomie is provided by the individual developer who publishes the Whomie app (shown as the seller on the app's App Store page). In these terms, "Whomie", "we", "us" and "our" mean the publisher, and "you" means the person using the app.
These terms are an agreement between you and us. By creating an account or using Whomie, you accept them. If you do not accept them, please do not use Whomie.
Our Privacy Policy explains how we handle your personal data.
2. Who can use Whomie
You must be 18 or older. You give your birthday when you sign up, and the app does not let you continue if you are under 18. If we learn that a user is under 18, we will delete the account.
You may not use Whomie if we have closed your account before for breaking these terms, or if the law forbids you to use it.
3. Your account and signing in
You can sign up with an email address and a password, or sign in with Google or LinkedIn (or Apple, if offered). When you use Google or LinkedIn, their own terms apply to that account too.
- Give true and current information about yourself, and keep it up to date.
- Use your own name and your own photos. Do not pretend to be someone else.
- Keep one account for yourself. Do not share it or sell it.
- Keep your password secret. You are responsible for what happens in your account. Tell us at once at admin@whomie.com if you think someone else has used it.
4. Your content and our licence
"Your content" means everything you add to Whomie: your profile, photos, room listings and messages.
You keep ownership. We do not claim ownership of your content.
You give us a licence. You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, resize, display and deliver your content, only to run and provide Whomie. For example, we show your profile and listing to other signed-in users, and we deliver your messages to the people you send them to. This licence ends when you delete the content or your account, except for copies we keep for the periods our Privacy Policy describes.
You alone are responsible for your content. This covers everything you post or send: your profile, your photos, your listings (including their accuracy, their legality, and your ownership of the room or your right to rent it out) and every message. The sender of a message alone is responsible for its content. You confirm that you have the right to post your content, that it is true, and that it does not break these terms or the law. Only post photos you took or have permission to use. Do not post photos of other people without their permission.
Under Turkish Law No. 5651, Whomie acts as a hosting provider ("yer sağlayıcı"). We do not check user content before it appears, and we do not endorse any user or listing. We may remove content that breaks these terms.
5. Acceptable use
Do not use Whomie to:
- Post fake or misleading listings. Only list a room that exists, that you are allowed to rent out or share, and with honest photos, rent, deposit and dates.
- Harass people. No threats, insults, stalking, unwanted sexual messages, or contacting someone again after they have blocked you.
- Discriminate. Do not post content that demeans or excludes people because of their race, ethnicity, nationality, religion, disability, sexual orientation or gender. Stating your household preferences with the app's own options, such as a gender preference for a shared home, is allowed where the law allows it.
- Scam people. Do not ask for money, deposits, bank details, passwords or identity documents under false pretences. Do not send links to phishing or malware.
- Advertise or spam. Whomie is for finding rooms and flatmates. Do not send bulk messages or advertise unrelated products or services.
- Share other people's data. Do not post anyone's address, phone number or other personal data without their permission.
- Post illegal or harmful content, including sexual content, violence, or content that encourages crime.
- Misuse the service. Do not scrape data, use bots, try to get around a block, break into accounts or systems, or interfere with how Whomie works.
Payments. Whomie does not handle payments between users. Any rent, deposit or other money you agree with another user, for example under a lease, is solely a matter between you and that user.
6. Meeting people and viewing rooms safely
Whomie only provides a platform where users find each other and communicate. Whomie is not a party, broker, agent, landlord or guarantor of any listing, lease, sublease, agreement, payment, deposit, meeting or relationship between users. We do not own, rent out or manage any room.
You alone are responsible for your conduct on Whomie and offline, for the people you meet, for viewings, payments, contracts and taxes, for complying with the law, and for checking the other person and the room. Whomie does no identity, background, listing or message checks, and does not endorse any user or listing.
You are solely responsible for your own safety when you meet people or view rooms. Some simple rules help:
- Meet for the first time in a public place, or bring a friend to a viewing.
- See the room in person before you pay anything or sign anything.
- Never send a deposit or rent to someone you have not met, or for a room you have not seen.
- Check that the person has the right to rent out the room, and read any contract before you sign it.
- Keep your conversations in the app until you trust the other person.
- If something feels wrong, stop, and report it to us.
If you are in danger, contact the police or emergency services first.
7. Reporting and blocking
You can report a user or a room listing in the app, and you can block a user.
- Blocking hides you and the blocked user from each other's people and chat lists. Neither of you can start a new chat with the other. Messages you have already exchanged remain.
- Reporting sends us the report. We review reports and may remove content, warn users, or suspend or close accounts.
We have zero tolerance for objectionable content and abusive users. We remove such content, and we suspend or remove users who post it or abuse others.
You can also write to admin@whomie.com about anything that worries you.
8. Copyright complaints
We respect the rights of others. If you believe content on Whomie infringes your copyright, email admin@whomie.com with the subject "Copyright Infringement". Please include:
- your name and contact details;
- the work you believe is infringed;
- where the content is in Whomie (for example, the user's name or the listing); and
- a statement that the information in your complaint is true and that you are the rights holder or are allowed to act for them.
We may remove the content and tell the user who posted it. We may close the accounts of users who infringe others' rights repeatedly.
9. Suspension and termination
You can stop using Whomie and delete your account at any time in the app: Settings → Delete Account. Our account deletion page explains what happens to your data.
We may remove content, or suspend or close your account, if you break these terms, if you put other users at risk, if you repeatedly infringe others' rights, or if the law requires it. Where we can, we will tell you why. If you think we made a mistake, write to admin@whomie.com.
We may also change or stop Whomie, or parts of it. If we plan to stop the whole service, we will try to tell you in advance.
The parts of these terms that by their nature should continue after your account ends, such as sections 4, 10, 11 and 12, continue to apply.
10. Disclaimers
To the maximum extent the law allows, Whomie is provided "as is" and "as available", without any warranty of any kind, express or implied. In particular, we give no warranty:
- that Whomie will be available, uninterrupted, fast, secure or free of errors;
- that profiles, listings, messages, maps or locations are accurate, complete, lawful or up to date;
- that you will find a room, a flatmate or any match or result; or
- that Whomie is fit for any particular purpose.
Profiles, listings and messages come from users, not from us.
11. Limitation of liability
To the maximum extent permitted by law, Whomie and its publisher are not liable for any direct or indirect damage or loss arising from or connected with:
- the app, your use of it, or not being able to use it;
- user content, including profiles, photos, listings and messages;
- the acts or omissions of any user, on Whomie or outside it;
- listings, leases, meetings, viewings, payments, deposits or any other transaction or agreement between users;
- third-party services, such as sign-in providers, maps, app stores and hosting providers; or
- loss of data, or interruptions, errors or the ending of the service.
This includes, for example, lost money, deposits or rent, lost profit or opportunities, and damage to property or reputation.
Mandatory law, including consumer law, still applies where it cannot be excluded.
Indemnity. You agree to indemnify and hold harmless Whomie and its publisher against all claims, damages, fines and costs (including lawyers' fees) that arise from your content, your messages, your conduct, your listings, or your breach of these terms or the law.
12. Governing law and courts
These terms are governed by Turkish law. Istanbul courts and enforcement offices have jurisdiction over disputes.
However, if you are a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you may also use the consumer bodies and courts that those laws make available to you.
Before going to court, please write to us at admin@whomie.com. Most problems can be solved that way.
13. Changes to these terms
We may update these terms when the app or the law changes, and we will change the "Last updated" date. If a change is important, we will tell you in the app or by email before it takes effect. If you keep using Whomie after that, the new terms apply. If you do not accept them, you can delete your account.
